Street Trading

The Council's Street Trading Policy is to create a street trading environment which compliments premises-based trading, is sensitive to the needs of residents, provides diversity and consumer choice, and seeks to enhance the character and safety of the local environment.

What is Street Trading?

  • Street trading means selling, exposing or offering for sale any article in a street. The term 'street' includes any road, footway or other area to which the public have access without payment.
  • Erewash Borough Council has adopted Schedule 4 of the Local Government (Miscellaneous Provisions) Act 1982, with consent streets designated within the Long Eaton Area and Prohibited streets designated within the Ilkeston area of the Borough. Consent Streets shall include all doorways, open areas, alleys, courtyards, forecourts and other areas to which the public have access without payment adjoining such streets.
  • The effect of this designation is that Street Trading in a Consent Street is prohibited (subject to legal exemptions) without first obtaining a Street Trading Consent from the Council.
  • Street Trading from a Prohibited Street is not permitted at any time. Anyone found to be trading in a prohibited street may be liable to prosecution. 

Street Trading Areas

The following consent streets were designated, to include all doorways, open areas, alleys, courtyards, forecourts and other areas to which the public have access without payment. These streets are sited within Long Eaton.

  • Derby Road from the Green to its junction with Granville Avenue.
  • Nottingham Road from its junction with Waverley Street to its junction with the Green.
  • Market Place.
  • Oxford Street.
  • Regent Street.
  • Union Street from its junction with Market Place to its junction with Salisbury Street.
  • Beaconsfield Street.
  • Stanley Street from its junction with High Street to its junction with Salisbury Street / Westgate.
  • High Street.
  • New Street.
  • Browns Road.
  • Cross Street.
  • Claye Street.
  • Orchard Street from its junction with High Street to its junction with Salisbury Street / Westgate Gibb Street from its junction High Street to its junction with Westgate.
  • Howitt Street.
  • Clifford Street.
  • Main Street to its junction with Oakleys Road.
  • Waverley Street.
  • Westgate.

 

The following Prohibited Streets were designated, to include all doorways, open areas, alleys, courtyards, forecourts and other areas to which the public have access without payment. These streets are sited within Ilkeston.

  • Market Place.
  • Wharncliffe Road from Market Place to its junction with Albert Street.
  •  Anchor Row.
  • St Mary Street for a distance of 50m from its junction with Market Place.
  • Bath Street from Market Place to its junction with East Street.
  • Market Street from Market Place to its junction with Coronation Street.

    Stall holders trading on non designated streets within the Borough are not required to pay a fee and are not regulated under the street trading legislation.

Exemptions

Some types of Street Trading are legally exempt from the need to obtain a Street Trading consent These include:

  • A person trading under the authority of a pedlar's certificate granted under the Pedlars Act 1871.
  • A trade carried out by a 'roundsman' such as a milkman.
  • A trade carried on at a petrol filling station.
  • News vendors in certain circumstances.
  • A trade carried out in a street adjoining a shop, provided it is part of the business of the shop (such business must not block the highway).
  • The authorised Street Markets situated in Ilkeston and Long Eaton. These markets are authorised and regulated by the Council's Market Officers and as such are subject to a separate fee structure.

Fees

  • The fee for street trading 'Daily Rate' is £15.
  • The fee for a quarterly permit is £250 per quarter.

Additionally, food sellers must be registered with their local Council Environmental Health department, and all traders must hold public liability insurance to the value of £5 million.

Please note, you do not need a Street Trading License if you are:

  • Not trading in licensed area.
  • A market trader operating at a licensed market venue.

Application Evaluation Process

It is in the public interest that the authority must process your application before it can be granted, therefore tacit consent does not apply. All applications should be processed within 28 calendar days. If you have not received a response in the given time period, please contact us.
