Public Registers

To ensure that the Council is transparent in its decision making the Council publishes details of certain decisions taken by council officers. This is a requirement of The Openness of Local Bodies Regulations 2014.

Under the above regulations, the Council is required to publicise certain decisions it makes where they have been delegated to an officer either:

  1. Under specific authorisation
  2. Under a general authorisation to officers to make such decisions and the effect of the decision is to:
  1. Grant a permission or licence
  2. Affect the rights of an individual
  3. Award a contract or incur expenditure which, in either case, materially affects
    that relevant local government body’s financial position.

The registers detail relevant decisions made by officers acting under delegated powers. The regulations do not require the Council to produce a separate record of a decision where this information is already required to be produced in accordance with another statutory requirement. The Council is not required to publish records of decisions which contain confidential or exempt information.

Public Registers for Licensing Act 2003

This information is provided as part of the council's statutory requirement to maintain public registers for Premises licences, Personal Licences and Temporary Event Notices under the Licensing Act 2003. Copies of the public registers are available to view by appointment at the Civic Offices, Derby Road, Long Eaton, Derbyshire NG10 1HU.

Public Registers for Taxi Licensing

Each Licensing authority is required to maintain a public register giving certain details of the current hackney carriage and private hire drivers' licences it has issued. Erewash drivers are issued with a dual licence which enables them to drive both types of vehicle. Section 42 of the Town Police Clauses Act 1847,Section 51(3) of the Local Government (Miscellaneous Provisions) Act 1976 & the Equality Act 2010 specifies the requirements for the public registers.

Please Note: Every vehicle on the designated list above has the capacity to accommodate a ''reference wheelchair''. It may still be advisable when making your booking to ensure that the operator has a suitable vehicle to accommodate your specific wheelchair or mobility requirements. It is possible that vehicles on these lists cannot accommodate larger types of wheelchairs.

Public Registers for Gambling Act 2005

Under the Gambling Act 2005 the council is responsible for issuing of various licences, permits and notices relating to the use of premises for gambling activities. We also issue Small Society Lottery registrations on behalf of non commercial societies that raise funds for charitable purposes.

Public Registers for Scrap Metal Dealer's Licences

The Scrap Metal Dealer's Act 2013 requires all scrap dealers to obtain a licence to deal in scrap metal, either as a  dealer operating from a site, requiring a Site Licence, or as a mobile collector requiring a Collector's Licence.

Charitable Collections

A permit or licence is required from the council for any street collection or house to house collections of cash, clothing or other assorted items.

Street Trading

The Council's Street Trading Policy is to create a street trading environment which compliments premises-based trading, is sensitive to the needs of residents, provides diversity and consumer choice, and seeks to enhance the character and safety of the local environment.
