If you experience damage, loss, or harm to yourself or your belongings and believe your losses were caused by the Council, you may wish to make a claim for compensation.
There are three ways to seek recovery of your losses:
- Claim through your own insurer – This is often the easiest and quickest way to recover your losses.
- Claim directly against the Council – You may submit a claim directly to the Council.
- Seek legal advice – You may consult a legal adviser regarding the merits of your claim. If you choose this route, ensure you understand any legal costs involved.
How to Submit Your Claim:
All claims must be made in writing and should be sent as soon as possible after the incident.
The letter should be addressed to:
Accountancy Department, Erewash Borough Council, Town Hall, Wharncliffe Road, Ilkeston, Derbyshire, DE7 5RP.
There is no formal claim form required; however, it is helpful if your written claim includes as much of the following information as possible:
- Full name
- Full address
- Contact telephone number and/or email address
- Date and time of the incident
- A description of the circumstances surrounding the incident
- Details of any injury, loss, or the total value of the claim
- A location plan or sketch indicating where the incident occurred
- Photographs of the incident or damage and/or other supporting documentation.
- Names and addresses of any witnesses
- Details of any conversations you’ve had with council employees related to the incident
If you submit a compensation claim for loss, damage, negligence, or harm you believe is the Council’s responsibility, our insurance team will review it before referring it to our insurance provider.

What Happens Next?
Once your claim is received, our insurance team will review the details. You may be contacted for additional information or clarification. The investigation process may take some time depending on the complexity of the claim.
Please note:
- Submitting a claim does not guarantee compensation.
- All claims will be carefully reviewed, and the outcome will depend on the merits of the case.
