Street trading means selling, exposing or offering for sale any article in a street. The term 'street' includes any road, footway or other area to which the public have access without payment.
Erewash Borough Council has adopted Schedule 4 of the Local Government (Miscellaneous Provisions) Act 1982, with consent streets designated within the Long Eaton Area and Prohibited streets designated within the Ilkeston area of the Borough. Consent Streets shall include all doorways, open areas, alleys, courtyards, forecourts and other areas to which the public have access without payment adjoining such streets.
The effect of this designation is that Street Trading in a Consent Street is prohibited (subject to legal exemptions) without first obtaining a Street Trading Consent from the Council.
Street Trading from a Prohibited Street is not permitted at any time. Anyone found to be trading in a prohibited street may be liable to prosecution.

Stall holders trading on non designated streets within the Borough are not required to pay a fee and are not regulated under the street trading legislation.

It is in the public interest that the authority must process your application before it can be granted, therefore tacit consent does not apply. All applications should be processed within 28 calendar days.
