Local Restriction Support Grant Application Process

The application form for both Local Restriction Support Grants 'Open' and 'Closed' is now available online on our Business Portal. Businesses operating more than one premises that is subject to the order to close or affected by Erewash entering Tier 2, must submit a separate application for each premises.

For businesses not occupying a premises on the ratings list, a separate Additional Restrictions Grant (ARG) will be available shortly and those businesses should apply for that grant using a separate form.

The Local Restriction Support Grant (Open)

This grant is available to eligible ratepayers, following the introduction of Tier 2 restrictions within Erewash on Saturday 17th October 2020.

Businesses need to have been severely impacted by restrictions placed on socialising and provide services such as Hospitality, Hotels, Bed and Breakfast or Leisure facilities.

Funding will be provided from 17 October 2020 until 4 November 2020, when the new national lockdown was introduced. When the national lockdown ceases, should Erewash remain in Tier 2 and circumstances remain the same for any ratepayer, this funding will automatically resume. Indicative funding suggested (but not yet determined by councillors - a local scheme will be approved in due course) will be based on your rateable value and may apply as follows:

Local Restriction Support Grant (Closed)

This grant has been introduced to cover the new national lockdown which commenced on Thursday November 5th 2020 and ends on 2nd December 2020. Those providing the following services are eligible:

  • Non-Essential Retail
  • Leisure
  • Personal Care
  • Sports Facilities
  • Hospitality Businesses

Businesses must have been forced to close for 28 days and have a rateable value. To receive funding you must:

  • Have made the council aware that you occupied a property directly before lockdown (i.e. up to and including 4 November 2020), and pay business Rates to Erewash Borough Council (if in receipt of rate relief you are also eligible).
  • Be closed to customers or have adapted your business to offer a food takeaway, collection or delivery service where you normally provide substantive seated restaurant or bar service.

The Health Protection (Coronavirus, Restrictions) (England) (No. 4) Regulations 2020 (SI 2020/1200) outline businesses that are required to close, these are listed together with further information on the Goverment's website.

There are a number of exclusions which are:

  • Businesses that have been able to stay open because they are deemed to be offering 'essential retail' or guest houses and hotels that are able to stay open to offer overnight accommodation to key workers
  • Businesses whose substantive business is a take away
  • Businesses that are able to continue to trade because they do not depend on providing direct in-person services from premises and can operate their services effectively remotely (e.g. accountants, solicitors)
  • Businesses that have chosen to close but not been required to will not be eligible for this grant. This includes business premises which were already closed directly before the restrictions were imposed
  • Businesses which have already reached the state aid limit
  • Business which are subject to insolvency or striking off action are not eligible for funding under this scheme
  • Specific businesses subject to national closures since 23 March 2020 will not be eligible for this funding. This includes nightclubs and sexual entertainment venues where grants will be paid under a separate scheme for nationally mandated business closures

 Funding is again based on your rateable value and the following thresholds & payments will apply:

The Additional Restrictions Grant (ARG)

The Additional Restrictions Grant is funding for local authorities to support businesses in their local economies. A one-off lump sum payment to fund additional business support will be provided by the government. We envisage this will primarily take the form of discretionary grants to businesses that don’t qualify for help under the above Local Restrictions Support Grant schemes, but we could also use this funding for wider business support activities. The aim is to provide appropriate support for the financial years 2020/21 and 2021/22 and we will publish further details about this scheme soon.

State Aid

Local Restrictions Support Grants count towards state aid. Payments count towards the total de minimis state aid allowed over a three-year period (€200,000). If you have reached that threshold, you may still be eligible for funding under the COVID-19 Temporary Framework where the limit is €800,000.

Tax implications

Grant income received by a business is taxable. The Local Restrictions Support Grant will need to be included as income in the tax return of the business.
