Environmental protection

Firms and individuals who wish to operate one or more of a range of prescribed processes are required to obtain an authorisation from us. The types of process that require such an authorisation are specified in regulations made under the Environmental Protection Act 1990.

Applicants are required to pay a fee on making application and if granted an authorisation they must pay an annual subsistence fee.

Any authorisation granted contains conditions to minimise air pollution that may be caused by the operation of the process.

The Pollution Prevention and Control Act 1999 has introduced a new two tier pollution control regime which is to be phased in over the next few years gradually replacing the Environmental Protection Act system.

The new regime has two sub groups:

  • Local Authority Integrated Pollution Prevention and Control (LA-IPPC) which covers sites known as A2 installations.
  • Local Authority Pollution Prevention and Control (LAPPC) which covers sites known as Part B installations.
  • Generally speaking the larger sites currently under local authority control will transfer from Environmental Protection Act authorisations to Part A2 installations.

At the moment Erewash has three A2 and fifty-two Part B’s. There are three A1 permits which are authorised by the Environment Agency.
